I began my career as an Assistant District Attorney in Bexar County. After leaving the District Attorney’s Office with an over 95% success rate during jury trials, I put my skills to work as a criminal defense lawyer prior to my election to the County Court at Law bench in 2010.

As a Judge, I saw how relentless prosecution could destroy the lives of those accused of crimes. I witnessed punishments exceeding the necessary restrictions and hypocritical prosecutors after a conviction, not justice. It compelled me to take my trial skills and compassion for the accused back into private criminal defense.

What Could Happen After Your DWI

If you are arrested for Driving While Intoxicated, your license will be confiscated and you will only have 15 days to request a formal hearing to avoid your license being suspended up to 2 years. Contact my office immediately upon posting bond to ensure you do not waive any of your legal rights.

In addition to license suspension by the Texas Department of Public Safety, penalties for DWI can require:

DWI 1st offense (misdemeanor)

  • Ignition interlock device installed
  • Up to 2 years probation or 180 days in jail
  • Can cost over $8000 in fines, fees and court costs
  • Rehab evaluation
  • Monthly/ random urine analysis
  • No mandatory 30 days

DWI 2nd offense (misdemeanor)

  • Ignition interlock device
  • Up to 2 years probation or 1 year in jail
  • Repeat offender
  • Mandatory 3 days jail (even if granted probation)
  • Over 13k in fines, fees and court costs
  • Driver’s license suspension

DWI 3rd or more or DWI (1st or 2nd) with a child in the car (Felonies)

  • Ignition interlock device or leg monitor bracelet worn
  • Up to 10 years in prison or 10 years probation. Up to 6 months prison prior to be released on probation possible
  • Over 20k in fines, fees and court costs
  • 80 – 200 hrs of community service
  • Loss of drivers license up to 2 years

Failed a Breathalyzer or Blood Test?

You can still challenge their results in court. Roadside tests are not admissible in court and Intoxilyzer machines and other chemical tests can be highly sensitive to some medications and medical conditions. I understand the law and the science behind these breath and blood tests.
